Terms of Service

1. Acceptance of Terms

By accessing or using SMSBulk ("the Service") at smsbulk.net, you agree to be bound by these Terms of Service. If you do not agree, you must stop using the Service.

You represent that you are at least 18 years old and have the legal capacity to enter into this agreement. The Service is not available to minors.

2. Description of the Service

SMSBulk provides SMS verification through virtual phone numbers sourced from third-party telecom providers. You purchase credit through cryptocurrency payments and use it to receive SMS verification codes from third-party platforms (such as messaging, social, marketplace, or developer services).

The Service is provided "as is". SMS delivery success depends on third-party platforms and telecom providers, neither of which we control directly. We make no warranty of guaranteed delivery, success rate, or service uptime.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We require strong, unique passwords and recommend enabling two-factor authentication when available.

You must provide accurate information during registration. We may suspend or terminate accounts that provide false information, attempt to evade bans, or otherwise violate these Terms.

API keys issued through the dashboard are bearer credentials. Keep them secret. Treat any leaked key as compromised, rotate it immediately, and contact @smsbulksupport if abuse is suspected.

4. Acceptable Use

You agree NOT to use the Service for:

• Illegal activities, fraud, or identity theft under any applicable jurisdiction
• Bypassing security measures, sanctions controls, or terms of service of third-party platforms
• Spam, mass account creation intended to harm, or automated abuse of any platform
• Harassment, threats, doxxing, or impersonation of individuals or organisations
• Resale, sublicensing, or redistribution of virtual phone numbers without our written consent
• Reverse engineering, scraping, or attempts to access non-public infrastructure
• Any conduct that involves child sexual abuse material, terrorism financing, or violence promotion

Violation of this section may result in immediate account suspension or termination, with no refund of remaining wallet balance, and may be reported to competent authorities.

5. Payments and Wallet

SMSBulk operates a prepaid wallet model. You add funds via cryptocurrency (USDT, BTC, ETH, TRX and others through Cryptomus) and your balance is debited per successful SMS verification. Pricing is shown transparently before each activation.

Cryptocurrency payments are final once confirmed on the blockchain. We do not control network confirmation times or fees. Payments are non-refundable to the original cryptocurrency wallet, except as outlined in our Refund Policy.

We reserve the right to update pricing with reasonable notice. Existing wallet balance is not affected by price changes; only future activations are charged at the new rate.

6. Refund Policy

When a virtual phone number does not receive an SMS within the activation window (default 20 minutes), or when you cancel an activation before SMS arrival, your wallet balance is automatically restored. See the Refund Policy page for full details and edge cases.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, telecom upstream outages, third-party platform changes, or unforeseen technical issues may temporarily affect the Service.

We are not liable for damages resulting from service unavailability, SMS delivery failures, or third-party actions (such as account bans by services you verify).

8. Disclaimers and Warranties

To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your requirements, will be error-free, or that defects will be corrected immediately.

9. Limitation of Liability

To the maximum extent permitted by law, SMSBulk shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, loss of data, or business interruption, arising from your use of or inability to use the Service.

Our total aggregate liability for any claim arising out of these Terms or the Service shall not exceed the total amount you paid us in the 30 days preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless SMSBulk and its operators from any claim, damage, liability, or cost (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your infringement of any third-party right.

11. Suspension and Termination

You may close your account at any time via @smsbulksupport. We may suspend or terminate accounts that violate these Terms, with or without notice.

On termination caused by a Terms violation, unused wallet balance may be forfeited at our reasonable discretion. On voluntary closure with no violation, remaining balance is refundable subject to verification, in line with the Refund Policy.

12. Intellectual Property

The Service, including its design, source code, logos, copy, and brand, is owned by SMSBulk or its licensors and is protected by intellectual-property laws. You receive a limited, non-exclusive, non-transferable licence to access the Service for its intended purpose.

You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our express written permission.

13. Third-Party Services

The Service depends on third-party platforms and providers, including telecom upstream and Cryptomus for payments. We are not responsible for the policies, availability, or content of those third parties. Their terms apply where you interact with them.

14. Changes to Terms

We may modify these Terms when our practices, providers, or applicable law change. Material changes will be communicated through the website and to registered users via email or in-app notice. Continued use of the Service after the changes constitutes acceptance.

15. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which SMSBulk operates, without regard to conflict-of-laws principles. The parties shall first attempt to resolve disputes through good-faith negotiation. Where negotiation fails, disputes are subject to the exclusive jurisdiction of the competent courts of SMSBulk's place of business, unless mandatory consumer protection law of your country provides otherwise.

16. Severability and Force Majeure

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect. Failure to enforce any right is not a waiver of that right.

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, civil unrest, government action, telecom or internet failures, or upstream provider outages.
